1. Introduction

SeaBookings is an online directory of sea experiences and its providers. These Terms of Service for MTOs (Maritime Tour Operators) apply to the contracts between SeaBookings and the suppliers of tours and activities – the MTOs. 

The terms “we”, “us”, “our” and “SeaBookings.com” refer to SEABOOKINGS, UNIPESSOAL LDA, a Portuguese corporation. The term “you”, “Tour Provider” and “MTO” refer to the MTOs listing their services on SeaBookings.com.

By using the services of SeaBookings or providing information to us, the MTOs agree to the Terms of Service of this Agreement. Please read the Agreement carefully. If you do not agree, please refrain from using the service.

4. Payment and VAT

VAT at the applicable legal rate will be added to all prices. Payments are annual and must be made before the service starts. An invoice will be issued shortly after the payment has been completed.

5. Redirection of Non-Boosted Experiences

Experiences that have not opted for the Boost for Experiences option will be redirected to the corresponding experience on GetYourGuide. Once the user is redirected, GetYourGuide’s Terms of Service apply.
If a non-Boosted experience does not have a corresponding listing on GetYourGuide, it will be archived.

6. Affiliate Links Disclosure

We include affiliate links in our directory to third-party platforms like GetYourGuide. If users click on these links and make a booking, we may earn a commission at no extra cost to the user or the local tour provider. This does not influence the listing of your experiences in our directory, and we remain impartial in the presentation of services. By listing your experiences with us, you acknowledge that your non-Boosted experiences may be redirected to third-party affiliate platforms, subject to their terms and conditions.

7. Translations

All translations provided on our platform are facilitated by an external service powered by AI. While we strive for accuracy, we do not guarantee error-free translations, and tour providers should verify important details if necessary.

8. Reviews

Reviews displayed on our platform may be sourced from multiple platforms, including Google Business, Get Your Guide and Viator, to provide a comprehensive overview of the client experience.

9. Cancellations and Refunds

You can cancel your MT profile or Boost for Experiences service at any time, but no refunds will be provided once the service has started. If you are dissatisfied, please contact us to discuss the situation.

10. Platform Responsibility

Our directory serves as a listing platform for nautical experiences. We are not responsible for managing bookings, payments, or any disputes between users and the listed companies. Our role is to provide a tool that connects consumers with businesses.

11. User Obligations

Listed businesses are responsible for ensuring that the information provided in the directory is accurate and up to date. Any attempt to provide misleading information may result in suspension or removal of the listing.

12. Displayed Content

The listed businesses grant SeaBookings a non-exclusive, royalty free and worldwide right to:

  1. Use, reproduce,distribute, sublicense, display and utilize (including without limitation to modify, adapt, copy, translate and make available to the public in any manner whatsoever) the provided content like information about activities and pictures;
  2. SeaBookings may offer this content in collaboration with affiliated companies and/or third parties;
  3. In no event shall SeaBookings be liable to the MTO for any acts or omissions on the part of any third party platforms. The sole remedy would be to request SeaBookings (which has the right and not the obligation) to disconnect with such a third party platform.

13. Custom Events at Sea

In addition to the Directory, we provide a booking service for group events on boats, including weddings, bachelor parties, birthdays, and networking events. We collaborate with selected partners, including boat operators and service providers (caterers, musicians, photographers), to offer a seamless booking experience for these events. The conditions are as follows:

  1. Role and Responsibilities We act as an intermediary between clients and tour providers. Our primary role is to manage the booking process and facilitate communication between the client and the provider. The tour provider is responsible for delivering the services and ensuring compliance with local regulations.
  2. Tour Provider Responsibilities: The provision of the boat and any additional services offered, such as catering, live music, or photography. Compliance with all local laws, including tourism registration and licenses. Providing appropriate insurance coverage for their services and equipment. Managing all liabilities related to the event, including safety and legal matters.
  3. Cancellation and Refund Policies: The tour provider sets the cancellation and refund policies. These policies should be clearly communicated to both us and the client at the time of booking. The client will be bound by these terms, and we will facilitate any communications regarding cancellations or refunds.
  4. Liability: SeaBookings assumes no responsibility for the actual delivery of the services. All claims, disputes, or legal issues arising from the event must be directed to the tour provider. The tour provider agrees to indemnify and hold SeaBookings harmless from any claims or liabilities related to the event.
  5. Insurance and Legal Compliance: Tour providers must have adequate insurance coverage for their operations, including liability insurance for any potential incidents during the event. Providers are also responsible for ensuring that their services comply with local laws and regulations.
  6. Relationship with Clients: While we manage the booking and communication process, the tour provider is responsible for fulfilling the services agreed upon with the client. Any specific client requests or changes must be managed directly with the client and communicated to us.

14. Marketing and Advertising

SeaBookings is entitled to promote the services of the MTOs in online marketing, including e-mail marketing and/or PPC advertising. It is in SeaBookings’ sole discretion how to advertise the services of the MTOs on its website or on third party websites and in online affiliate networks.

15. Use of Data for Marketing Purposes

SeaBookings uses the MTOs’ data for marketing activities, such as for sending emails, and updates.

We wish to obtain the following declaration of consent: I agree that every month, SeaBookings will send me useful information about the maritime tourism industry by email. You may revoke this consent with SeaBookings at any time. All that is necessary is to send an email to: [email protected].

16. Limitation of Liability

We are not liable for any loss, damage, or harm resulting from the use of our service or information provided by third parties. By using our directory, you accept these risks.

17. Changes to the Terms of Service

We reserve the right to change these Terms of Service at any time. Changes will be communicated via email and will take effect 30 days after notification.
